The fastest way to form an LLC
Filing online with expedited processing is your fastest option in states where standard online filing is not already immediate. Most states that offer expedited processing will turn your LLC around in a few hours or by the next business day.
That extra fee is worth it if you are racing a contract deadline, signing a lease, closing a funding round, or need to open a business bank account fast. Delaware, for example, offers a 1-hour priority option for an additional fee, which can be worthwhile when a deal genuinely depends on same-day approval.
Otherwise, standard online filing in most states is quick enough - usually 1 to 3 business days. Before paying for speed, compare the expedited fee against the standard online approval window.

This is the method I recommend for almost everyone. It is faster, easier to track, and you are less likely to have a document get lost or delayed in transit.
States with immediate or same-day online approval include Alabama, Alaska, Colorado, Connecticut, Kansas, Nevada, and South Dakota. In those states, paying for expedited processing is usually unnecessary.
Expedited mail filing (2-5 business days)

In-person filing (same day where available)
Not all states offer in-person LLC filing, so check your state's Secretary of State website before you plan around it.
Where it is available, in-person filing usually means walking into the filing office and waiting for same-day or short-window processing, sometimes for an additional fee. It can be useful if your state allows it and you need speed without relying on a mailed document.
What slows down LLC formation?
State processing windows are a starting point, not a guarantee. A few things can push your timeline out further.
- Filing method: This is the biggest variable. Expedited online filing can get you approved in hours. Standard mail can take the better part of a month.
- Documentation errors: If your Articles of Organization have errors or missing information, the state can reject them. Common issues include a business name that does not include the required designator (LLC, L.L.C., or Limited Liability Company), a registered agent address that uses a PO box instead of a street address, or a missing organizer signature. Each correction restarts the processing clock.
